The author examines the formula “ut inter bonos bene agier oportet et sine fraudatione” of the actio fiduciae from the point of view of its internal meaning. In particular, on the grounds of the sources of the third and second century B.C. the author argues (confirming the results of his recent research) that the qualification “vir bonus” underlying the words “inter bonos” indicates an ethical-behavioural perspective, not a social status; and proposes a reading’s hypothesis that attaches an autonomous role to the adverb “bene” (generally considered pleonastic respect to the terms “inter bonos”). Il presente contributo intende indagare le connessioni tra linguaggio giuridico e la formazione del giurista di diritto privato. In un contesto caratterizzato da un sempre maggiore deterioramento del linguaggio usato dal legislatore, occorre concentrare l’attenzione sul ruolo del linguaggio giuridico come elemento centrale della scienza giuridica. Il problematico processo di “emancipazione” delle corti dal dato normativo testuale suggerisce di formare il giurista in modo da prepararlo ad un’attività ermeneutica che assegna sempre più rilievo al contesto, facendo emergere la storicità del diritto e le strutture economiche e sociali sottese alle varie norme, con un approccio metodologico che …
